INTERNATIONAL MONEY TRANSFER PAYMENT
TERMS AND CONDITIONS

  1. GENERAL TERMS
    1. PAYMASTER (JAMAICA) LIMITED (“PAYMASTER” or “we” or “us”) offers the service of payment to our customers of international money transfers sent from overseas via our international third-party partners into Jamaica (“Services”).
    2. As used in this Agreement, the term "Site" is the Paymaster website that Paymaster operates. By accepting electronically, installing, accessing or using the Services, you agree to be bound by the Terms of this Agreement and Paymaster’s Privacy and Security Policy, as they may be amended from time to time in the future. BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE. IF YOU DO NOT AGREE, DO NOT USE THE SITE.
    3. By using the information, tools, features, software and functionality including content, updates and new releases provided by Paymaster, you agree to be bound by this Agreement, whether you are a “Visitor” (which means that you simply browse the Paymaster-online.net website), or a “Customer” (which means that you have registered for an account with us to use any one of our Services).
    4. The term “you” or “User” refers to a Visitor, Member or Customer.
    5. The term “we”, “our” and “us” in these terms may also include our licensors, agents, parent company and affiliates from time to time.
    6. If you wish to become a Customer or want to make use of the Services, you must read this Agreement and indicate your acceptance during the registration process by signing the physical receipt or by selecting “I Agree” on the webpage.
    7. You may not use any of the Services and you may not accept this Agreement if you are not at least 18 years of age and, in any event, of a legal age to form a binding contract with Paymaster. If you accept this Agreement, you represent that you have the capacity to be bound by it.
    8. Paymaster reserves the right, at its sole discretion, to change, modify, add or remove portions of this Agreement, at any time. It is your responsibility to check this Agreement periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes.
    9. As long as you comply with this Agreement, Paymaster grants you a personal, non- exclusive, non-transferable, limited privilege to enter and use the Site.
  2. THIRD-PARTY LICENSEE AND PAYING AGENT
    1. The money that you are collecting is being paid to you by us on behalf of a third-party licensee (the “Licensee”).
    2. The Licensee received this money from the person who initiated the international money transfer (the “Sender”) so that it may be received by you.
    3. Paymaster is an authorised remittance agent licensed, approved and regulated by the Bank of Jamaica (BOJ). and we have the authority to pay this money to you on the Licensee’s behalf.
    4. You can collect this money from any Paymaster location authorized to conduct international money transfer transactions. The list of all authorized locations can be found here:
  3. RECEIVING A TRANSFER
    1. To receive the money from a Sender at a location, please follow the steps below:
      • Step 1: Visit a Paymaster location near you during its opening hours.
      • Step 2: Provide the Paymaster clerk ("Representative") with the reference number that is given to you by the Sender. Upon your transaction reference number being verified by the representative in the system, please be aware that we will require you to provide, among other things, the following information:
        • Your full name, date of birth, address, phone number, email address, nationality, and gender;
        • Information about your proof of identification;
        • The purpose of the transaction;
        • Your relationship with the sender; and
        • Your sender's source of funds
      • Step 3: Provide the Representative with a government-issued photo ID that clearly validates the identification information that your sender has provided on the money transfer transaction.
      • Step 4: The Representative will verify that your photo ID matches to your face to validate the transaction before paying it to you.
      • Step 5: If the Representative is satisfied, the money will be counted in front of you, and you will receive the cash and two copies of your receipt. This cash shall be paid out in Jamaican Dollars at the rate in effect on the date the money is sent by the Sender f sending and displayed on the receipt the Sender receives. .
      • Step 6: Sign the receipt to confirm that you have received the money in full and return one copy to the Representative.
    2. If you are not able to provide all the documents and information required, or if the Representative has any doubts about their validity, accuracy or authorization, the Representative is not obligated to make payment to you.
    3. Payments may be halted for anti-money laundering purposes without notice to you.
    4. Collection at Paymaster may only be made during the operating hours of the relevant Paymaster location and subject to their compliance with local regulatory requirements.
    5. If you do not collect money available to you for collection at Paymaster within ninety (90) days, the transfer will expire and we will have no obligation, after that ninety (90) day period, to make that payment to you.
    6. The uncollected money may be sent back to the Sender.
  4. INFORMATION WE COLLECT - DATA PRIVACY
    1. Paymaster is required to comply with the Anti-Money Laundering (AML) and Counter Financing of Terrorism (CFT) Legislation.
    2. Paymaster has established policies and procedures consistent with the Proceeds of Crime Act (2007) and the Proceeds of Crime (Amendment) Act 2013, The Proceeds of Crime (Money Laundering) Regulations 2007 and all other applicable legislations and the Bank of Jamaica’s Guidance Notes.
    3. Money Laundering is defined as engaging in acts illicit or otherwise designed to conceal or disguise the true origin of criminally derived proceeds so that it appears to have been originated from a legitimate source. In fulfilling the regulatory requirements of the AML/CFT legislations and BOJ Guidance Notes, Paymaster has in place “Know Your Customer” (KYC) policies and procedures and is therefore required to accurately maintain records of customer identification and verification, transaction and source of funds, as well as an expected transaction profile of its money transfer customers.
    4. Paymaster and its agents are required to obtain client information and verification of residency which may include, but is not limited to, obtaining:
      • Tax Registration Number or any similar document such as National Insurance Scheme Number/Social Security Number/Tax Insurance Number;
      • country of residency
      • place of birth;
      • government issued identification;
      • bank account or transaction verifications; and
      • any other documentation as required by the regulatory bodies.
    5. Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our privacy notice, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities in the event you have a query or complaint about the use of your personal information.

  5. FRAUD PREVENTION
    1. PROTECTING YOUR ACCOUNT
    2. As a user of our Services, you are agreeing to our terms, including that you understand how our services are to be used and that you will do your part to ensure that your money is safeguarded to prevent against unauthorized use or fraud. You are required to notify Paymaster immediately if you have identified unauthorized transactions on your account or suspicious activity to prevent further losses. Users are expected to leverage the following guidance in an effort to minimize such activities.
    3. FRAUD PREVENTION WARNING (Receive Side):
      • Never receive money from someone you do not know or for a no clear purpose
      • Never accept to receive money on behalf of someone else
      • Never provide your identification to someone to receive money on your behalf
      • Never share the Reference Number you obtained from your Sender with a third party
      • Never use a fake identification or provide false information to receive money
      • Please do not share the details of your money transfer with anyone else.
  6. NO WARRANTIES
    1. The Sites, Services, information, data, features, and all content are provided to you on an “as is” and “as available” basis. Paymaster, its affiliates, and its third-party providers, licensors, distributors or suppliers (collectively “Suppliers) make no representations or warranties of any kind, express or implied, as to the content or operation of the site or of the services. You expressly agree that your use of the Services is at your sole risk.
    2. Neither Paymaster nor its Suppliers make any representation, warranty or guarantee that the content that may be available through the services is free of infection from any viruses or other code or computer programming routines that contain contaminating or destructive properties or that are intended to damage, surreptitiously intercept or expropriate any system, data or personal information.
    3. All warranties, representations, and conditions which are implied by statute or otherwise are expressly excluded to the extent permitted by applicable law and you hereby waive and release us from all such warranties of any nature.
    4. We do not authorize anyone, including but not limited to Paymaster agents and employees, to make any warranties on our behalf and you should not rely on any such statements.
  7. INDEMNIFICATION

    You agree to indemnify and hold us, our merchants, suppliers, vendors, agents and their respective subsidiaries, affiliates, officers, directors, agents, partners, employees, and consultants, harmless from any claim or demand. This includes indemnification from reasonable attorneys' fees, made by any third party due to or arising out of your use of the Services, your connection to the Services, your violation of these Terms or any law, or your violation of any rights of a third party.

  8. LIMITED LIABILITY
    1. WE ACCEPT NO RESPONSIBILITY FOR THE ACTS OR OMISSIONS OF A SENDER, LICENSEE, OR ANY OF THEIR SERVICE PROVIDERS OR THEIR DESIGNEES.
    2. WE WILL NOT BE LIABLE TO YOU:
      • FOR ANY DELAYS OR MISTAKES, OR ANY CLAIMS, LOSSES, OR DAMAGES, RESULTING FROM ANY CIRCUMSTANCES BEYOND OUR CONTROL, INCLUDING, WITHOUT LIMITATION, ACTS OF GOVERNMENTAL AUTHORITIES, NATIONAL EMERGENCIES, INSURRECTION, WAR, RIOTS, EPIDEMIC, ENDEMIC, OR PANDEMIC;
      • FOR ANY CLAIMS, LOSSES, OR DAMAGES RESULTING FROM YOUR FAILURE TO COMPLY WITH THESE TERMS, COMMUNICATION SYSTEM FAILURES, OR FAILURES OR MALFUNCTIONS ATTRIBUTABLE TO ANY EQUIPMENT, ANY INTERNET SERVICE, OR ANY PAYMENT SYSTEM;
      • IF WE ARE UNABLE TO COMPLETE A TRANSFER BECAUSE YOU ARE SUBJECT TO A HOLD, LEGAL PROCESS OR OTHER CLAIM RESTRICTING TRANSFERS AT THE TIME WE ATTEMPT TO PAYOUT;
      • IF THE SENDER DID NOT FOLLOW THE TRANSFER INSTRUCTIONS PROPERLY; OR
      • IF YOU DID NOT PROVIDE US WITH CORRECT, COMPLETE, VALID AND TIMELY INFORMATION OR PROOF OF IDENTIFICATION.
  9. ADDITIONAL TERMS
    1. We reserve the right, at any time in our sole discretion, to change, suspend, remove, or disable the Services without notice or liability.
    2. You may not transfer or assign any obligations or responsibilities arising from these Terms to third parties in any way and may not make any third party a partner to responsibilities written in these Terms for any reason.
